Court Rulings in the Republic of Korea in Favor of Victims of Human Rights Violations by North Korea and Its Leader Kim Jong Un Victims of human rights violations by the Democratic People’s Republic of Korea (DPRK) have sued both the DPRK and its leader Kim Jong Un in Republic of Korea courts, and are receiving rulings in the victims’ favor. In their lawsuits, the DPRK is viewed as a private association under the Civil Act of the Republic of Korea and Kim as the head of this association. Because the DPRK and Kim have not responded to the litigation, the courts have rendered their rulings via the system of “service by public notice.” Under this system, if a party to a lawsuit refuses service of documents and fails to comply with trial proceedings, the documents are posted on the message board and official gazette of the presiding court, and the party in question is considered to have been served the documents.
